Workplace Safety And Health (Registration of Factories) Regulations 2008

Any organization/person who wants to occupy a piece of land or use any premises as a factory, falling within any of the classes of factories described in Part I or II of the First Schedule, shall apply to the Commissioner to register.

The application (accompanied by particulars, information, statements and documents) to register the premise as a factory shall be sent to the Commissionerin such form and manner as he may require. The application has to be made at least one month before the factory starts operation.

On receiving an application, the Commissioner will go through the details of application before deciding whether the premise is deem fit to be register as a factory. Upon successful application, the Commissioner will enter the factory in the register of factories and on successful payment of the fee specified in the Second Schedule, a certificate of registration will be issue to the applicant to certify the premise fit for operation.

4) Where any machinery moved by mechanical power is used in any workplace, then notwithstanding anything in this Act, it shall be the duty of the owner of the machinery to ensure -

a) so far as is reasonably practicable, that the machinery is maintained in a safe condition; and

b) that the precautions (if any) to be taken for the safe use of the machinery and the health hazards (if any) associated with the machinery is available to any person using the machinery.

5) Where the owner of any machinery moved by mechanical power has entered into a contract of hire or lease with a hirer or lessee, the duty imposed under subsection (4) shall apply to the hirer or lessee of the machinery instead of the owner.

6) Where the owner, hirer or lessee of any machinery moved by mechanical power has entered into a contract with another person to maintain the machinery, the duty under subsection (4)(a) shall apply to that other person instead of the owner, hirer or lessee of the machinery.

7) Subsections (1), (2) and (3) shall apply only to machinery or equipment specified in Part I of the Fifth Schedule.

HSE self inspection

The purpose of the HSE self inspection is to carry out inspection throughout the facility to identify for any substandard conditions or practices which may cause harm or injuries to personnel within the working area. At Sanofi-Aventis, it has always been the company's policy to investigate accidents/incidents and, where possible, to prepare reports and recommendations to prevent the recurrences of such accidents/incidents. The prime objective of an accident/incident investigation is to identify immediate and fundamental causes which will then define the corrective and preventive controls to be put in place.

Accidents/Incidents investigation involves the methodical examination of an undesired event that did, or could result in physical harm to people, damage to property, loss to process or loss to environment. It is directed towards defining the facts and circumstances related to the event, determining the causes, and developing remedial actions to control the risks.

Current Practice

It is the company policy to prevent accidents/incidents and improve health, safety and environmental performance by:

1. All accident/incident regardless of whether it causes minor or major injuries, damages to property, process loss or loss to the environmental shall be reported to the HSE Department through the Accident/Incident Reporting Form.

2. A joint investigation teams will be established such that the size of the team and the depth of investigation are proportional to the nature of the hazard and/or the nature of the incident.

3. From the accidents/incident investigating analysis, recommendations will be drawn up and put in an action plan and the information will be used to inform employees to prevent such recurrences.

Gaps:

1. Employees do not report accidents/incidents that are too minor. E.g. breaking of lab bottles contain small amount of solvents, small cuts, small spillages, small bruises cause by knocks, etc.

2. Employee think is a hassle to report such accidents/incidents.

3. Employee does not know the actual procedure of filing a report.

4. Little or no participation in the investigation team. Often push to HSE department to carry out the investigation.

Permit-to-work system

The purpose of a permit to work system is to ensure that a specific work that is carried out on a potentially hazardous plant or equipment is carried out in a safe manner. The permit form itself is a specially designed document which is issue by an authorized person where certain tests have been made, precaution taken, and specifying extra precautions which must be observed by users of the permits. The permit requires the person(s) who is undertaking the job to report to the authorized person first. The permit eliminates, as far as possible, the human errors which could occur if there is no formal written procedure to follow. However, the permit, in itself, does not make the job safe but is dependent for its effectiveness on the persons concerned carrying out the requirements conscientiously.

Current Practices:

- The permit to work is issued by an authorized personnel identified under the Register of Permit Issuers.

- The authorized person has undergone training by the HSE manger to be certified.

- The supervisor in charge who is applying for the permit shall specify the type of permit he is applying for.

- The supervisor in charge shall then describe the scope and location of the job being carried out.

- The authorized person shall then accompany supervisor in charge to the workplace to check on the protective and preventive measures that are set in place.

- Once the authorized person is satisfied with the preparation, he will issue the permit to the supervisor in charge.

- Lack of monitoring by supervisor in charge. Normally left after permit is issue.

- One permit is applied for 2 scopes of works that are happening at the same time.

- One permit covering 2 scope of work that are at different locations.

Routine safety inspections should be carried out to ensure the workplace, including the workers, are in compliance.

3. Continuous reviewing and monitoring of the objectives and targets.

Company should routinely review the objectives and targets that are set to ensure they are in compliance.

4. Reviewing and updating of safety policy, procedures, P&IDs, risk assessments, etc.

Seminars organized by workplace safety and health related association will sometimes discuss and inform companies on what the recent and future changes in the legislation.

3. Attending WSH related courses.

Lecturers for OSHAS 18000, ISO 14000, WSQ courses need to be kept up to date on the changes in legislation such that students are taught and kept informed of the latest changes.
